Thank you for accessing the USA TODAY Wine Club, operated by My Wines Direct, Inc. ("we" or "My Wines Direct") We respect your privacy and want to protect your personal information. To learn more, please read this privacy policy.

 

Do I need to be a Member to use this Site?

No membership is required in order to browse the usatodaywineclub.com web site (the "Site"), however you must create an account upon your first purchase. This creates your unique customer id, and provides us the information on file for future purchases, order history and other information available in MyAccount. In this privacy policy we refer to a user as someone whose address is on file as the result of a purchase or as otherwise provided to us through the Site.


What information is collected?

Personally identifiable information is collected when a user provides it to us, such as when a user creates an account or makes a purchase, either through the Site, via telephone or through the mail, or provides updated information as they continue to use the Site. In addition, we collect information from users at various other places on the Site, including through user reviews and survey information submitted by users. We may also receive information about users from other sources and add it to the information you provide to us.


Do you share customer information?

We do not share the personal information of our users, except with (a) business partners in connection with their provision of services to My Wines Direct, such as fulfillment and shipping companies to ship orders, credit card processing company to bill members for goods and services, hosting company to operate this Site, state reporting for age verification; and (b) in response to subpoenas, court orders or legal process or if we believe that a user’s actions violate applicable laws, the Terms of Use or threaten the rights, property or safety of My Wines Direct, other users, or other persons or entities.

My Wines Direct may also share aggregated demographic or other information with its business partners. This is not linked to any personal information that can identify any individual person.


Do you use cookies?

Your Internet browser has a feature called "cookies" which stores small amounts of data on your computer about your visit to the Site. We use a cookie to store a unique session identifier, and this allows us to maintain a user's shopping cart and wine selections from one page request to the next. We are also able to maintain a user's session information from one visit to the next. By setting a cookie on the Site, a user does not have to log in more than once while on the Site. A user may elect not to allow cookies to be collected by adjusting the settings on the user's browser. If a user rejects the cookie, he may still browse the Site, however such user may be unable to log in or make a purchase.


Does My Wines Direct maintain Log Files?

We use IP addresses, or log files, to analyze trends, administer the web site, diagnose service issues, track a user's movement and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.


Who provides the security for the secure area of your web site?

When users enter sensitive information (such as a credit card number) on the Site, that information is encrypted and protected with encryption software provided by Thawte. While on a secure page such as the Site's order form, the lock icon on the bottom of Web browsers such as Microsoft Internet Explorer and Netscape Navigator becomes locked, as opposed to unlocked, or open, when you are just "surfing." In addition we take appropriate measures to implement offline procedures intended to protect user data and we have policies in place which limit access to such data to those employees, contractors or agents who need access to the information to perform a specific task (for example, our customer service representatives have access to personally identifiable information in order to respond to requests). How do I correct or update my personal information?

In order to provide our services, we need to have accurate and current information about you. If a user's personally identifiable information changes (such as your shipping or billing address, your preferred credit card, etc.), you should add new information or delete any outdated addresses or credit cards from the user's account at the My Account page of the Site. A user can also modify login information and opt out of email and/or postal communications from the My Account link at the top of any page on the Site. What happens to my information if My Wines Direct is sold?

As a natural consequence of the development of My Wines Direct, we could be sold to another company. In the event that another company acquires us or a significant portion of our assets or business, all of the customer information, including both financial records and other personal information that we have collected, may be transferred to the new company in order that the My Wines Direct service (or its successor) may continue to be provided to you or for other business purposes.


How can I stop getting communications from you?

Users may login to MyAccount and change their preferences. Additionally users or other recipients may opt out of receiving future communications by mailing a letter to us at Member Services, My Wines Direct, 477 Devlin Road, Suite 106, Napa, CA, 94558; by calling toll-free 1-866-813-4411, or by writing to memberservices@usatodaywineclub.com.


How do you administer the Fair Credit Billing Act?

We guarantee that every online transaction you make with us will not create liability for you in the event of unauthorized charges. This means you pay nothing if unauthorized charges are made to your credit card as a result of shopping at the Site’s online store. Under the Fair Credit Billing Act, your bank cannot hold you liable for more than $50 of fraudulent charges. If your bank does hold you liable for any of this $50, My Wines Direct will cover the entire liability for you, up to the full $50. We will only cover this liability if the unauthorized use of your credit card resulted through no fault of your own from purchases made while using our secure server. In the event of unauthorized use of your credit card, you must notify your credit card provider in accordance with its reporting rules, policies and procedures.


What should I do if I believe my Account is no longer secure?

If you have reason to believe that your Account is no longer secure (for example, in the event of a loss, theft, or unauthorized disclosure or use of your email address, password, or any credit, debit, or charge card number used for the Site), you must promptly change your password and notify My Wines Direct of the problem.


How will I know if this Privacy Policy changes?

We may update this privacy policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the email address you have provided to us, including a notice in our newsletters or by placing a prominent notice on the Site.
